At issue was police entering the Holmes Avenue residence before a search warrant was obtained- and a trash can that was eventually taken from the property and searched.

A man who told Saint Rita's employees that he strangled and killed his girlfriend back in January was back in court on Thursday.

A motion to suppress hearing in the case of the state versus Raymond Collins took place before Judge Richard Warren.

At issue was police entering the Holmes Avenue residence before a search warrant was obtained- and a trash can that was eventually taken from the property and searched.

43 year-old Theresa Burge- was found dead in the home by police.

The Judge ruled the police had probable cause to enter the residence on an emergency call- and that the trash can was okay to be searched- since it was on the property- so those motions to suppress were overruled.
